Ustawa z dnia 15 grudnia 2000 roku

Ustawa o zasadach zbywania mieszkań będących własnością przedsiębiorstw państwowych, niektórych spółek handlowych z udziałem Skarbu Państwa, państwowych osób prawnych oraz niektórych mieszkań będących własnością Skarbu Państwa. Czytaj dalej

 

 

 

 

Art. 1. 

1. Ustawa reguluje zasady i tryb zbywania mieszkań wchodzących w skład budynków mieszkalnych, będących własnością przedsiębiorstw państwowych, niektórych spółek handlowych z udziałem Skarbu Państwa, państwowych osób prawnych oraz niektórych mieszkań będących własnością Skarbu Państwa, osobom uprawnionym, na warunkach preferencyjnych.

 

2. Mieszkania, o których mowa w ust. 1, nie wchodzą w skład przedsiębiorstwa w rozumieniu art. 551 Kodeksu cywilnego.

 

 

 

Art. 2. Ilekroć w ustawie jest mowa o:

 

1)   zbywcy - należy przez to rozumieć:

 

a)  przedsiębiorstwa państwowe, z wyłączeniem przedsiębiorstwa państwowego Polskie Koleje Państwowe,

 

b)  spółki handlowe, w odniesieniu do których Skarb Państwa jest podmiotem dominującym w rozumieniu art. 4 pkt 16 ustawy z dnia 21 sierpnia 1997 r. - Prawo o publicznym obrocie papierami wartościowymi (Dz. U. Nr 118, poz. 754 i Nr 141, poz. 945, z 1998 r. Nr 107, poz. 669 i Nr 113, poz. 715 oraz z 2000 r. Nr 22, poz. 270, Nr 60, poz. 702 i 703, Nr 94, poz. 1037, Nr 103, poz. 1099, Nr 114, poz. 1191, Nr 116, poz. 1216 i Nr 122, poz. 1315),

 

c)  inne państwowe osoby prawne, z wyłączeniem Wojskowej Agencji Mieszkaniowej,

 

2)   osobie uprawnionej - należy przez to rozumieć:

 

a)  pracownika lub byłego pracownika zbywcy, który zajmuje mieszkanie na podstawie umowy najmu zawartej na czas nieoznaczony lub administracyjnej decyzji o przydziale,

 

b)  osobę bliską pracownikowi lub byłemu pracownikowi, której przysługuje wstąpienie w stosunek najmu mieszkania na podstawie przepisów ustawy z dnia 2 lipca 1994 r. o najmie lokali mieszkalnych i dodatkach mieszkaniowych (Dz. U. z 1998 r. Nr 120, poz. 787 i Nr 162, poz. 1119, z 1999 r. Nr 111, poz. 1281 oraz z 2000 r. Nr 3, poz. 46, Nr 5, poz. 67, Nr 83, poz. 946, Nr 88, poz. 988, Nr 95, poz. 1041 i Nr 122, poz. 1317),

 

3)   mieszkaniu - należy przez to rozumieć:

 

a)  lokal mieszkalny - w rozumieniu przepisów ustawy z dnia 24 czerwca 1994 r. o własności lokali (Dz. U. z 2000 r. Nr 80, poz. 903) będący własnością zbywcy lub będący we władaniu państwowej osoby prawnej, która wykonuje prawo własności na rzecz Skarbu Państwa,

 

b)  zabudowaną jednorodzinnym budynkiem mieszkalnym nieruchomość gruntową, będącą własnością zbywcy lub oddaną mu w użytkowanie wieczyste; działka nie powinna przekraczać rozmiarów niezbędnych do prawidłowego i racjonalnego korzystania z budynku i urządzeń z nimi związanych.
